In accordance with the regulations from articles 6. and 10. of the Law of Public Organization and citizens Associations ( “ Official Journal of the S. Republic of Serbia no: 24 from April 30th , 1982. ) Assembly of the Citizen Assoociation “ European Movement in Serbia – Local Council Nis, on the meeting held on April 10th , 2004. in Nis, accepted this

STATUTE OF THE ORGANIZATION “ EUROPEAN MOVEMENT IN SERBIA – LOCAL COUNCIL NIS “

 I – General regulations

Article 1.

 “European Movement in Serbia Local Council Nis “ ( in the further text EPuS-LC Nis ) is the dependent and voluntary association of citizens founded as non- political, non-governmental and non-profitable organization.

Article 2.

• Name of the organization reads: “ European Movement in Serbia- Local Council Nis ” Name of the organization in English reads: “ European Movement in Serbia – Local Council Nis “ .

• Abbreviated name in English reads : EMinS-LC Nis.

Article 3.

•  - European Movement in Serbia-LC Nis with residence in Nis, 22, Josifa Pancica street.

Article 4.

• European Movement in Serbia-LC Nis does its activities on the territory of Serbia.

• European Movement in Serbia-LC in the scope of its activities cooperates with Citizens Association of European Movement in Serbia with residential address in Belgrade, related to European International Non-govermental Organization of European Movement with residence in Brussels.

Article 5.

• - European Movement in Serbia-LC Nis passeses the round Seal and engraved text on it European Movement in Serbia-Local Council in Nis’ written in Cyrillic letters and in English. In the middle of the Seal it stands “ Nis “.

II Aims and Activities of EPuS-LC Nis

Article 6.

Aims of the European Movement in Nis are:

1. Improvement of understanding, mutual acquaintance and cooperation of people and communities and stimulation of manifold free communication among them, first of all in the field of culture, education, ecology, information, economy and politics.

2. Improvement of cultural cooperation among nations, regions and countries of Europe as the part of European contribution to peace and welfare of prosperity in the world.

3. Influence on public opinion of Nis and Serbia to engage their abilities toward fulfillment of equality of people and their communities while accepting the standards of European community.

4. Education of citizens of Serbia and specially citizens of Nis for taking part in democratic process and participation in selfmanagement.

5. Stimulation and development of though and speech.

6. Protection of human rights and citizen freedom.

• Fulfillment and realization of these aims understands activities of European movement in Nis directed toward:

• Peaceful soLCing of conflicts among individuals and communities.

• Ideas of justice and against any kind of violence.

• Cherishing of cooperation at the level of regions and among citizens and communities in Serbia as well as in international level.

• Development of nonprofitable sector in Serbia.

• Respecting of human dignity but against human rights violation.

Article 7.

• In the process of realization of it’s the European Movement in Serbia

• LC Nis acts, first of all, in the sence that its members do the following things in accordance with the law: - Permanently cooperate with other organization with similar aims on the territory of Serbia and on International level.

• Organize round tables, discussion panels, consultation and workshops as well as other types of education of citizens.

• Develop alternative forms of theatre, film and video production.

• Organize manifestations devoltedto expanding of work results and research of European Movement in Nis.

• Participate in activities of local and broader community which improve life quality in economics, culture and other fields of interest.

• Organize scientific and expert employees for the work on scientific and expert research projects which contribute to realization of the aims of EPuSW-LC Nis.

• Inform the public about the results of their work by the means of public information.

Article 8.

• European Movement in Serbia -LC Nis can become a member of broader types of citizens associations.

Decision about access of the European Movement in Serbia - LC Nis to the federation of citizen associations or international organizations is issued by the Assembly according to the rules from article 15. of this Statute. In the case of access or enrollment into international organization, president of European Movement in Nis is obliged to inform organs of this movement about the access to the international organizations.

III Membership

Article 9.

• Members of the European Movement LC Nis can be the citizens of our country of foreign citizens, national or foreign legal or physical entities who accept the aims and goals of the Movement and the Signature of the European Movement in Serbia LC Nis.

• Membership is verified by signing of applicatrion form and verification of the same by the Managing Board. Signature on the application form means acceptance of Program-Declaration and Statute of the European Movement in Serbia LC Nis.

European Movement in Serbia – Local Council Nis consist of:

• Individual members

• Collective members

• Associate members

• Honorary members

Article 10.

• A member of the European Movement in Nis may resign from membership by issuing written declaration about resignation.

• A member of the European Movement could be excluded from thee European Movement in Nis if he violates the regulation from articles 6. and 7. of this Statute by inadequate conduct.

• Voting right ceases to exist for a member of Assembly of the European Movement because of his passive attitude to work or because of membership fee lack of payment in the period of one year.

• Managing board of the European Movemnt in Nis decides about exlusion from membership and issues written decision to the excluded member.

• Appeal could be submitted to the Assembly of the European Movement in Nis concerning exclusion from membership in 15 days time from the reception of the decision issued by Managing Board.

• Final; decision of exclusion from membership is issued by the Assembly on the first incoming meeting.

Article 11.

 A member of EPuS-LC Nis has the right to:

•  - Take part equally with other members in fulfillment of the aims of EPuS-LC Nis.

• - Directly participate in making decisions at the Assembly of EPuS- LC Nis or indirectly by the organs of EPuS-LC Nis.

• - Elect and became elected for the organs of the European Movement in Nis.

• - Became informed timely and thoroughly about activities of EPuS-LC Nis. -

A member has the obligation to:

• - Contribute actively to the aims of EPuS-LC in Nis.

• - Participate according to interests and abilities in activities of EPuS-LC in Nis.

• - Fulfill other activities entrusted to him by the Managing Board.

IV Organs of European Movement - Local Council Nis

Article 12.

Organs of the European Movement in Serbia- Loacal Council Nis are:

• Assembly

• President

• Vice-president

• General secretary

• Executive Board

• Supervisory board

Article 13.

• Assmbly of EPuS- LC Nis consist of all its members.

• Assembly can be of regular and special occasion type.

• Regular assembly meetings are held once a year.

• Special ioccasion assembly meetings are held on the request on the third of members, on the request of President orExecutive Board

Article 14.

 Assembly of EPuS-LC Nis has the following tasks:

• Issues Operating Procedure

• Accepts the plan and program of activities of EPuS-LC Nis.

• Accepts and changes the Statute

• Elects and realeses the president, vice-president, general secretary, members of Executive Board and Members of Supervisory Board.

• Considers and accepts operating report issued by the President and the Executive Board.

• Considers and accepts financial plan, balance sheet and Supervisory Board report.

• Decides about proposals of organs or members of EPuS-LC Nis.

• Decides about joining of EPuS-LC Nis some broader types of citizen and international organizations.

• Decides about submitted appeals concerning the Executive Board decisions.

• Issues decision concerning membership fee amount.

• Elects honorary members

• Assembly is authorized and competent for all issues which, by this Statute and its decision, are not given to the authority of some other organ of the European Movement in Nis.

Article 15.

• Assembly issues valid decisions if more that a half of members are present.

• Assembly decides by the majority of votes of present members.

Article 16.

• President of EPuS-LC Nis is elected by Assembly.

• President is obliged to do the following:

• Represent and proxy EPuS-LC Nis in the country and abroad.

• Consider realization of program orientation of the European Movement in Nis.

• Preside over the assembly meeting of EPuS-LC Nis.

• Preside over the work of Executive Board.

• Mandate of the President lasts four years.

• In the case of the President of EPuS-LC Nis absence inability to preside over meeting or in agreement with him, deputy president of the European Movement in Nis presides over the activities.

Article 17.

• Executive Board is the executive organ of EPuS-LC Nis.

• Executive Board takes care of realization of the aims determined by the Statute and decisions of the Assembly.

• Executive Board has its president, vice-president, general secretary and members elected and realesed by Assembly.

• Mandate of the Executive Board members lasts four years.

Executive Board

• Issues operating procedure

• Manages activities of EPuS-LC Nis between two meetings and issues decision concerning realization of the aims of EPuS-LC Nis.

• Organizes regular realization of activities of EPuS-LC Nis.

• Proposes to the Assembly the access to broader types of citizen associations and international organizations.

• Issues decisions and entrusts certain activities and tasks to some members.

• Issues financial decisions for EPuS-LC Nis.

• Proposes procedure for changing and supplementing the Statute.

• Executive Board issues valid decisions of one half of members is present and issues decisions by the majority of votes of present members. In the case of equal number of votes the vote of the President decides.

Article 18.

General secretary takes care of valid performance of activities of EPuS-LC Nis, specially of realization of decisions of its organs as well as realization of program decisions. He manages the activities of the office and coordinates activities concerning realization determined financial obligations of EPuS-LC Nis. General secretary appoints the members of the secretariat and may appoint the associates and his own assistant. He provides the procedure of keeping record of activities of all the organs of EPuS-LC Nis. Mandate of the General secretary lasts four years.

Article 19.

• Supervisory Board perform supervison over financial transactions of EPuS-LC Nis ad submits the report to the Assembly

• Supervisory Board has three members.

• Members of Supervisory Board are elected by Assembly.

• Members of Executive Board can not be the members of Supervisory Board.

• Mandate of the Supervisory Board lasts four years. V Financing of European Movemnt in Nis

Article 20.

activities of EPuS-LC Nis are financed out of:

• membership fees

• donations

• application for projects of state organs or foundations and organizations

• other sources according to law.

Article 21.

European Movement in Serbia-LC Nis is responsible for its liabilities exclusively with its property.

Article 22.

• Assets of EPuS-LC Nis could be used exclusively on the basis of financial plans following the Executive Board decisions.

• President or general secretary of EPuS-LC Nis is the exclusive warrant for usage of assets.

• Supervisory Board controles usage and availability of assets of EPuS-LC Nis. VI Transitional and final regulations

Article 23.

• Activities of EPuS-LC Nis are open to the public.

• Managing Board takes care of regular informing of members and public about work and activities of organization directly or through media.

Article 24.

• Decision concerning termination of activities of EPuS-LC Nis is issued by the Assembly.

• In the case of termination of activities EPuS-LC Nis the Assembly issues the decision concerning managing of property and if such decision is not issued then the property of EPuS-LC Nis belongs to the Assembly of the City of Nis which may be use for the support of similar organization on its territory.

Article 25.

• Sign of EPuS-LC Nis is determined by the Executive Board.

• Sign coulde used on memorandums, publications, advertising material as well as for public designation and announcement of activities of EPuS-LC Nis.

Article 26.

• proposal for changes and amendements of the Statute of EPuS-LC Nis could be given by one third of membership, by Executive Board and by President.

• Decision concerning changes and amendements is issued by the Assembly according to the regulations from article 15. of this Statute.

Article 27.

• This Statute comes into effect on the day of registration on front of the authorized organ and is going to be used from the day of entering into the Registrar Book kept by authorized organs.
